If you are sure about the switch and have a good story to tell, I would raise it again soon, emphasizing that you like the firm and want to stay. This assumes you would prefer to lateral if they won’t go for it. Depending on your credentials, and especially in this market, you shouldn’t have a problem lateraling, even as a first-year, and I don’t think it will change your resume that much whether you do it early next year or let an entire year pass. Letting that much time pass isn’t great for your happiness or staying up to the level of others in your class year in transactional.
I would try to build some internal support from partners in the transactional practice and they may be able to more effectively advocate on your behalf!
I would say as much as you like your firm/the people, something as fundamental as you not being able to make a switch to lit to transactional should be a deal breaker. If you really want to be transactional, think about how your career and opportunities are being narrowed to an area of law you don’t even want to do, if you stay at this firm or wait until next year to see if there’s more room. Also..is your firm a litigation heavy one like Skadden? As far as most of big law is concerned, there are so many firms desperate for additional bodies in their transactional groups, who will reward you handsomely as well with a nice signing bonus.
Also for what it’s worth, I would reach out to partners in the groups you might want to be in and gauge with them directly if they have capacity. They may know of someone planning to lateral, take leave, etc. And know ahead of recruiting or other admin the anticipated capacity.
