Just because they asked for this doesn’t obligate you to agree. Yes it seems dishonest and they are doing it so they do not have to repay it as they will use your salary to as a valid expense that will be forgiven, and get your work for free. They are cheating the government because it is intended to help small businesses retain salaried employees. You can always say your accountant told you it has to be as a 1099 worker OR you could say that they should give you healthcare etc. if they want to treat you as an employee. I wouldn’t suggest the latter.
Trust your gut. 99% of the time it’s right. It’s a balance between a paycheck and integrity.

If you were to do it, I would increase your rate (top: 100k a year) because you now won’t be able to tap into your tax expenses as W9.
I would also have a contract with a kill fee so you don’t screwed over. (can you do that with W2? not sure)
you’re doing them a favor.. we all know why. At the end of the day I don’t think they will be able to get away with it. 100% of it the loan is not forgivable. Nobody reads the fine print 😣
also consider the fact that this person is doing this.. do you really want to work with a person like that?

It was messy but ultimately yes - I was scared I wouldn’t get paid otherwise. It was to pay for me for money they already owed me and were dragging their feet on. What I realized later though (I’m pretty sure) was they forced freelancers on payroll to keep payroll costs up, to be able to later get forgiveness while not actually hiring back the full-time people they laid off. I’m not working there now. As far as I’m concerned this was a one time thing to ensure I got paid.
Seems like it’s better for them, but weigh your tax situation for next year. I’d avoid switching back and forth from IC to W2.

If they want you to go on payroll it’s because their 2019 payroll average is larger than their current average and they need to make up the difference. I don’t know how much you charge a day but the MAXIMUM they can pay you is a little over $2,000 a week for it to be forgiven through the PPP. Anything over the weekly sum equal to $100,000 a year will not be forgiven. So they’re essentially saving $2,000 a week. So you need to ask yourself how much is it costing you in lost revenue through taxes, lost pass through income if you’re incorporated, etc.

If you haven’t already, get a good accountant and talk to them about this. They’ll know the answer.
