In New York it’s illegal for them to ask your current salary. They could ask what you’re looking for, or you salary expectations. But I encourage you to ask them what their budget is. Number are facts and they should be straight forward with you about it.
This was in NY. I wasn’t sure if third party recruiters know about numbers yet or not. I should’ve done my due diligence. Guess I’ll know better next time. 😅
Could also say “I would prefer to have a salary discussion once the interview process is further along. It will help to see what my role will be like.”
This is good too, but could hinder things a bit if they’re hot to hire, and want to make sure the targeted number is realistic for the approved budget.
Always increase your number by 10-5k. if you REALLY want 80k, ask for 90k
Say, "My current salary is x" x is the salary you want.

It’s illegal in NY but still a very common practice, especially with agency recruiters. But it really depends on the role and what you’re targeting. Rather than lie about what you’re currently making, focus on the role. You can use PayScale or a similar site to input the responsibilities and level then confirm that the company has the right amount budgeted for the role. Or, as mentioned above, you can politely decline to share until you know more about specific roles. Here are some sample word tracks:
“I’m targeting compensation in line with senior roles with 1-5 direct reports that oversees initiatives for companies in the 50-200 employees range. I’m showing that to be between 90-120k depending on (city/suburb or industry). What do you have budgeted for the position?”
“I prefer not to share my expectations at this time so I can learn more about the impact the role will have on the organization and the expectations for success. I’m currently in a team lead to entry manager professional salary range and looking to focus on roles where the scope of responsibilities will grow in the next 5 years. Can you tell me more about the career path for this position? Why is there a vacancy?”
It’s not allowed in NYS. Whether 3rd party, or in-house. Just respond “I’m targeting $___”. You don’t have to (and should not) disclose your current or past salary info.
If they ask again, just keep repeating your desired salary back to them. 🙃
You can’t ask that but you can ask, What are your salary expectations”.
If anyone asks you what you are making answer them “well what I am looking for is x” I would recommend always giving your expectations before you continue with the interview. If you are looking for 100k, and you don’t disclose that in the beginning, you may be wasting your time if the role only pays 70k. I agree always give a little more so there is room for you to grow, and room for negotiations. Hope this helps!
It is illegal to ask what you are currently earning in NY. This goes for recruiters too. Other states have also introduced legislation on this subject. After describing the position and location we ask candidates, based on what we have described what compensation range would you look for? We advise people before going to an interview if they are asked the compensation question say; based on the level of responsibility, direct reports and size of the facility, I have earned between x and x.
