Oof. Aren’t you giving notice by asking for waivers?
That’s the tricky part…the new firm said I need to get these before I officially give notice because they can’t employ me unless they clear. I guess this is common but it feels really awkward. Don’t want to lose both jobs!
Just a fair warning. I did this and ultimately couldn’t get the waiver. Lost both the job I had and the one I wanted. Tread carefully and know who you are dealing with.
Agree with the above. You should not be the one getting the waiver. When I lateraled to my previous firm, I needed a waiver and the new firm took care of obtaining it without involving me or letting anyone at my old firm know.
The conflicts people at the new firm reached out directly to the client they needed the waiver from. It took forever (read 7 weeks) because of course this client wasn’t concerned with reviewing a conflicts waiver for a lawyer who didn’t even work on their matter. But it eventually got done.
Had this issue. There’s no way around it unfortunately or at least there wasn’t for me. From my situation, they needed a waiver from both sides of the conflicts. I tried to approach the partner and not give official notice but they took it as official notice anyway.
