Anyone else feel like being a lawyer is mostly calling other lawyers asking them to complete discovery they owe you and lawyers calling you asking you to complete discovery you owe them? And we’re just in this cycle of never being able to actually complete discovery we owe other lawyers because we’re on the phone asking other lawyers to complete discovery they owe us?! And on and on it goes...

And 99% of the discovery you’re fighting about will never matter at trial, if one ever happens.

I’m an associate coming up on my one-year anniversary of being an attorney. It’s starting to make sense why my partners leave most of the discovery to me. Pretty tedious stuff.

Well eventually there’s a mediation or trial or MSJ and you can close the book on discovery for the one case. I more and more hate written discover and just prefer to jump to depositions of corpsorate reps to get the infor

Even depos are nonsense. You spend hours getting the witness to say what everyone in the room knows happened but he/she’s sitting there with the same nonsensical answers that you hear time and time again in depos. The general problem with litigation is you spend most of your time fighting about “what happened,” when the basic facts (did you speak with this person, what did you say, etc) should be easy to establish. Obviously people lie and hide the facts but I’d soooo much rather fight about who’s right based on a set of facts than fighting about that set of facts. Litigation is basically paying people to hide the ball.

So, when can I expect to get that discovery you owe me?

I promise I’m working on it!!! 😂😭

So this is what I’m paying outside counsel to do???

I added a well recognized litigator in my area at a top firm on LinkedIn... reason being is that I’m a first year in litigation and hope to accomplish at least half the things he has in my career. So it’s interesting to see his takes on things when he engages on a post.

I’m tempted to send him a personal message, not for a job or anything, but honestly just to ask “how he did it” and what advice he might give.

Is there any harm in this? Don’t wanna be annoying.
