My firm requires only 1650 but I still struggle to meet it. This is compounded by the hell of dealing w/clients complaining every month for explanations, credits, etc over legit time on their invoice. OTOH, I know I'm dealing with individuals, not businesses, and most of the time they're financially vulnerable to begin with so I'm sensitive to not overbill, which in my experience produces diminishing returns during the representation. Do I ask for more work or just keep (over)billing?

Does anyone have a good file management system they would be willing to share that keeps track of all of the dates on each file (since family law has so many, at least in Ontario) and notes from conversations with clients/emails, all in one place for ease of reference.

2 days ago i told the resp on the phone i had a divorce petition to mail him and needed his address. He said he would call me back with the address because he was driving, just moved to a new place, and didn't have it memorized. He never gave it to me but i found it anyway and mailed it certified. Today i found out that he cleared out their bank account. Can i do an emergency hearing to get that money back? He does not physically have the petition yet but i definitely told him it was coming.

Annual compensation discussion coming up. With a VERY minimal base salary w/a % of collections, what do you think is fair? Currently, structure is a flat amnt quarterly as a bonus once a certain amnt is collected, but nothing additional than the minimal salary if collection gol isn’t achieved. Then, at year end, 1/3 of every $ over the collection threshold. I’ve never missed a collection goal, but am not gong far over it. What is a fair goal, and a fair %, assuming salary non negotiable?

How much of family law can be done remotely?

My client wants both parties to list assets & liabilities as an exhibit to their prenup without values, but waive the right to know the actual valuation of those in the prenup itself. My initial thought is this is a terrible idea & would probably make the prenup easily voidable since a main requirement for a prenup is for both to understand the nature and value of the other’s assets. I will research in my jurisdiction to confirm, but has anyone ever heard of/done this? Thoughts?

CA attorneys: I have a client who got a court order that the kids are supposed to visit with him (kids are in another state) and now it appears that the kids may not follow the order, client already paid for their flights. Any suggestions on what to do? Ex parte? File the order in the other state to enforce the order? Hold the other parent in contempt? Thanks!

Billing question - Do you have clients pay an outstanding balance within 30 days of sending out your account or earlier? I’ve heard some firms require clients to pay as soon as the account is rendered (ie. within 5 business days) but not sure if clients actually do that in reality and you end up chasing them? Any creative ideas are welcome!

How many of you have taken cases to your state court of last resort? My firm is taking a child welfare case to our state supreme court (not NY— so the actual last court.) Just curious about others’ experience(s). Very clear from the intermediate court that the panel didn’t bother to read the record on appeal. Very frustrating that my client’s last shot is discretionary when the trial court ignored my client and the one guaranteed appeal had a panel that couldn’t bother
