Anyone here retool from a transactional practice to lit? Are you happy with your decision? I usually see the opposite move.

But the exit opportunities tho. Why would you give that up to be a senior lit associate one day with no career prospects other than keep eating the pie you won in the pie eating contest?

Edit to be more helpful: it’s certainly possible, especially if you’re willing to take a year off to clerk, but think long and hard about why all the lit associates are retooling into a corporate practice despite lit being a more interesting Biglaw practice.

A second year I work with did that this past fall. He has adapted well and it suits him much better (according to him). He finds it a lot more intellectually stimulating.

Lit is just such a grind. The cool parts are VERY cool - depos, oral arguments, trials - but unless you are working at a known “trial” firm that mostly isn’t what you’re doing. Mostly you’re having endless compliance conferences with the court that could’ve been an email, arguing with opposing counsel who are being difficult for no reason, and slogging through discovery that will almost certainly be pointless because nearly all litigations settle before trial anyway.

The ratio of work arguably gets better as you get more senior, but then you have to start business development. Litigation is largely a one-off relationship, so unless your practice area also includes a transactional/counseling component (like L&E) or you land a super-litigious client, you’re going to be constantly on the hunt for new business for as long as you’re trying to make partner/being a partner. (That, or constantly splitting/losing credit to a transactional partner who will internally refer their clients to you for lit.)

And the exit opportunities for a pure litigator without a subject area specialty are… not awesome.
