Nope. You are not protected following leave. They can fire you the day you return. They can lay you off on leave as well, if it’s part of a larger layoff.
Happened to me.
I’ve known people to get laid off while on maternity leave, so no. I’ve also know many women to get paid off while super pregnant.
I don't believe there is any such protection.
The FMLA protects your job (or an equivalent role, if things change when you're on leave) for 12 weeks. Sadly, I think that's it.
Do you have (a) specific concern(s)?
I thought that was the point of the FMLA - guaranteed position when you return no? Barring other layoffs sure but if it’s protected when you return just wondering for how long .. has to be more than a day...
Same theory: they don’t owe you special treatment, just same.
So if their ducks are in a row regarding performance warnings or need for a lay-off or restructure, they can let you go or change your job.
Btw, the law is they have to keep your job or a similar job open, so you can me moved around legally.
Chiming in to agree/confirm. There are no such protections around FMLA or parental leave. Typically if someone is being laid off/furloughed during or following mat leave it will be more closely scrutinized in the legal reviews that happen prior to these actions to ensure the company can prove it was justified.
