In my area of the country, binding arbitration is presided over by 3 volunteer practicing attorneys, mostly plaintiffs lawyers.

In this case, our complaint is filed for two intentional torts, but not negligence. However, as the case has developed, negligence is a strong cause of action here. Specifically because the intentional tort is part of a doctrine which also provides that a Plaintiff will succeed in negligence under this theory under certain facts, which are present in our case.

We plead negligence and contributory negligence in the counterclaim. Defendant clearly did negligence, and it is technically raised in the pleadings. Anyway to let some duty of care/breach of duty come in, because the doctrine of our intentional tort also allows for a finding of negligence? Not sure how much we can get in at binding arbitration, but it would be huge to show some negligence.

FWIW, we were outside the SoL on adding negligence by the time I discovered we should add it. I was added to this case very very late at close of discovery.

Can you try to amend?

Sounds like a matter that should be reviewed for malpractice and not for suggestions on a forum. Good luck.

Just wrapped my first year in analytics for due diligence. I’m a finance-savvy data guy, not an accountant. Mostly work with SAAS-model targets. Most clients are PE. May be a silly question but more of a sanity check…

Party A (licensee) signed a non-exclusive license with B (licensor). B subsequently signs an exclusive license with C (second license).

Does the signed exclusive licensing agreement impede on A’s non-exclusive rights, OR is the exclusive license subject to the prior non-exclusive agreement? OR is the “exclusive” license automatically deemed non-exclusive but still valid?

Note: the initial non-exclusive license stands in perpetuity.

Sent a partner an MSJ on March 15. He sent comments at 11:55 today. I have a time sensitive appeal due today that I’m working with the paralegal to get everything ready. I told him won’t have time to revise the MSJ, let alone get the affidavits from our clients/experts signed but I could get it ready for Monday. He’s upset because “this really needs to be done today and when he sends things to an associate, he is counting on the associate to get it done.” No question, just needed to vent.

First-year associate here. I’ve gotten research assignments where, even after hours of research, I haven’t found a clear answer. I know this can be normal, as there’s not always an answer to a research question, but I can’t help feeling bad for not having an answer to bring back to the partner/assigning attorney. My grandmother died and the funeral was Friday. I took Thursday and Friday off. I let one of my supervisors know what was going on, told the other two I would be out, and got all my assignments in order. I let another partner im working with know I’d get her a draft motion by Monday because I had a funeral. Then our client emails us, and she’s sending me emails like “call me in the morning to discuss,” etc. Can I assume that she just didn’t read the funeral part? No one acts like this, right?
