Drainmydeck - only for felonies where there is willfull intent to share information. Similar cases where there was violation of 18 US Code 798 and 18 US Code 793 without intent to distribute information for US v. Nishimura and US v. White didn't result in imprisonment either though both parties were found or plead guilty.
@d3. If she could sit out the next 8. I am also fine with it.
Yup. She's a criminal. If anyone else did what she has done- they would be in prison. Can't vote for trump either though😭 so torn this election cycle
A1 - In the US we have this concept of innocent until proven guilty. You might want to familiarize yourself with it.
But let's look at the things Clinto has been accused of:
1. Clinton exclusively used a private email address while serving as Secretary of State from 2009-13.
Not a jail-able offense
2. Some classified information ended up on her private server, which was an unclassified server
FBI investigation did not find enough evidence to charge her.
3. Clinton skirted State Department rules about records management, security and transparency.
Violation of policy but not jail-able offense. Congressional hearing found no email tampering or deletion.
4. Clinton’s email setup exposed her to hacking.
Still not a jail-able offense
So instead of spouting BS sound bites, tell me what exact jail-able offense has Hillary Clinton been charged with?
Let's face it Brady saw more of a punishment for deflategate. Hillary should be sitting these 4 out.
Having spent the last 14 years working with the highest clearance available, she clearly met the intent to disregard the failsafes put in place by our classification system. It's not rocket science. We know that classified items were sent to her. Classified documents reside in a separate computer system (SIPR) that doesn't touch the unclassified system. It takes intent to put a classified document into an unclas email. Period. So someone had to put an external drive into a classified machine and put classified docs into it and then put those docs onto an unclas machine. That's willful. It doesn't just happen. It's NOT like accidentally replying all or some such nonsense. Look, I don't care who you vote for but surely it has to resonate that someone who wants to lead the country viewed herself as above the law and had a staff willing to do things that are illegal. There's a reason five of them were granted immunity. You don't get immunity unless you need it. Vote for her if you want but don't be blind in your political faith to the FACT that she was careless with classified material. That speaks to a hubris that even Trump can't match. By the way, I've been involved in a prosecution of a service member who accidentally wrote some classified stuff into an unclas PowerPoint. The months of legal chaos, immediate loss of his security clearance and subsequent dismissal from the Navy were very real outcomes of "careless" handling.
Killary? Honestly, didn't think that I'd gear that phrase here
Actually those are jailable offenses for government employees with clearance. That's the problem.
Jailable or not, she was not found guilty under the law.
Exactly why I am on this thread. Anything but Clinton.
drainmydeck - Let me be clear: I'm specifically calling out the ignorant sound bites stating opinions that Clinton should be jailed for her negligence/criminal intent.
Reread my post. I asked A1 what the exact jailable offense Hillary Clinton has been charged with. Even with your 14 years of experience, you provided incomplete (at best) and inaccurate (at worst) information that only applies to felonies where intent to distribute is the case.
I provided actual cases and similar legal precedents where the accused DID NOT get jail time.
Then you provide a wall of text which still doesn't provide any support for A1's argument.
Loss of security clearance =\= jailable offence.
Also careless with classified materials =\= jailable offence. USA v. Nishimura; USA v. Berger; USA v. White.
Arrogance =\= jailable offense. USA v. Petreus
Intent to ignore failsafes =\= jailable offence. USA v. Deutsch
YUP.
I feel like only a male would ask that question
So you're going to vote for Trump? A vote for anyone but Hillary is essentially a vote for Trump
D2 - you realize the NFL is a private organization that can suspend players based on internal business decisions not transparent to the public, right? The Federal government is not able to prosecute or suspend people at will like the NFL. We fought a war for that, due process ring a bell?
A2. Amazing how you can listen to serial and watch "making a murderer" and somehow think the system got it right this time. The only reason she got away with it is the political prostitution the Clinton's have been doing the last 30 years. Wonder who she owes favors to now.
Yes.
That is what the Trump supporters say also. Frankly sick of it. No. It is a vote for the person voted for.
Deck drainer, I, too, have a clearance and was deeply disappointed by her behavior. One quick thing though- I believe the majority of the items that were "classified" ended up being classified after the fact. For example, as political events unfold, people in that country can email about the events and then after the fact, the material is classified. This was not the case for all, but many. I know, I know. If it were not for the email incident, I would have gotten involved with the campaign sooner.
