Are we allowed to ask the candidate to show us their current comp when we negotiate?

Not in NY. It’s illegal, and frankly — a poor practice for pay equity.

likefunnyhelpful

Seriously. 🤦‍♀️

likefunny

Literally illegal in California.

like

Don’t do this. It’s illegal in some states and very unfair to the candidate. Future comp should never be tied to what they are currently earning. You already know how much you can afford to pay and what the job is worth.

The question enables the hiring company to pay people as little as they can possibly get away with. Instead, ask candidates how much comp they are looking for. And then give it to them.

@ACD Copy, I don’t have problem with a company negotiating compensation. That’s how companies keep their overhead down, and that’s fine. But basing an offer on current comp is wrong, and, like many of us have already mentioned, it’s illegal. Full stop.

likesmart

Illegal in most states. I’d avoid. How do you not know this?

likeupliftingsmart

@TAS- this is troubling that you’re asking this as it’s been broadly and resoundingly rejected both ethically and legally.

However? Maybe you’re from a different country non USA?

Either way, in wherever you live, it’s a bad practice and it reproduces income inequality and bias in every industry that it is allowed to continue.

Don’t do it.

And this is why HR is like walking in to the DMV

You tell me yours so we can counter ours.

No, it’s illegal in many states.

Genuine question: what do recruiters (or 3rd party recruiters) get out of offering and hiring someone under budget? Does it just look good for them to be able to save the company a few thousand dollars? Do third party recruiters get paid more if they are able to hire someone cheaper? What is the benefit to this? 🤔

likesmart

In-house recruiters: a quicker approval process with Finance. BUT... screws up margins and market values/expectations in the long run.

3rd Party: usually on commission, I can only imagine it makes them look good with a 1st time client they want more business with, or if they have some kind of “volume placement” discount with existing clients.

You know, I’m going to go against the grain here. Go ahead and do it. 🍻🍿

funny

You cannot ask this in New York.

likesmart

It used to be legal in nyc. It really kept my compensation low. Since they made it illegal, I make double. Check your local and state laws.

Be better. Asking them to show proof is a poor way to start a relationship. If they’re worth it and asking for a fair price, pay them.

like

My name is No

funny

Also even if you are allowed, then you come across as though you’re paying them what they’re worth but rather than what someone else defined them to be worth. Maybe they’re leaving because their pay doesn’t reflect their value. Or maybe their pay isn’t increasing at the level of their progression. Pay is a poor indicator of someone’s added value to your company. Judge that for yourself

If you’re talking about a full time placement, the only upside is goodwill with the client. If it’s a contract / freelance role, they make more $$ off of you.

I hope there is some scam going on in the name of Fujitsu India consulting.
Last week I got selected and they collected documents after week they rejected saying high expectations. Earlier they accepted for same salary hike.

Same happened for my friend today. He also got selected and they collected all the acedemic , previous company documents salary slips and they rejected him saying same.

They could have told the same when they ask for salary expectations. I feel something fishy.

Negotiation help needed:

Have an offer for about 50% more than I currently make. During application process they made you give your target salary. The offer on the table is $10k over my initial number AND during interview process they talked about fast career ascention opportunities (6 months or less).

1. I feel like I should negotiate bc that's the thing to do.
2. I also feel like I have no leverage bc they're already over my initial target by $10k and talking promotion in 6 months. Help!
