Attorneys- admission on motion question: does 5 years in an accounting firm count for admission on motion to another jurisdiction?

In my experience, no. I wish there could be a special rule for tax attorneys who intend to solely practice in tax. I see no reason why my 1 year of practice in a small tax law firm primarily doing tax returns and trust accountings (my boss used the associate attorneys as accountants for the most part) somehow would count as “practicing law” while my 5 years in public accounting doing more sophisticated tax consulting work for Fortune 500 companies doesn’t allow me to waive in to another state, to practice tax law only.

My state just went UBE but the state I’m trying to be admitted to is not UBE.

Be careful with this one and check your jurisdictions rules on UPL. This issue has made its way to the supreme court before bcause the bar does not view it favorably.

What’s the case that went to the supreme court so I can look it up?

No. Generally need to be “practicing law.”

Agree or disagree — for a B4 tax practice, service line partners are actually more Atkin to middle management and managers are not really “management” in the traditional sense. Ie, we have don’t really have much to say on the strategic direction of our practice.
