Turn off the "spell check ignores all caps" setting, folks

Yes! It’s soooo easy.

Every few sentences “August” would appear mid-sentence. Opposing counsel also misspelled his name in the pleading caption.

Did you guys not see my first federal “MOTION TO DIMISS”? Thankfully, I have since learned how to turn on spellcheck for all caps😅

Received interrogatories today - the very first one says to “tate your full name, address...”

Received an interrogatory response from defendant saying “Defendant is liable for...” OC amended eventually to add the missing [not].

I am conducting settlement negotiations by phone with opposing counsel (Plaintiff) tomorrow, for the first time. OC so far has been cordial and reasonable. I do employment law, if that makes a difference. Other than making it clear that their claims are weak and should settle for our offer (and also we don't have a trial date yet so it could be at least a year before we could even get to trial), what other tips do you all have?

What is a reasonable amount to accept to settle a case with undisputed liability? Let’s say for example potential damages are realistically $100k-1M. Let’s say cost of defense is $200k. No chance of them getting out on SJ or a MTD. Is cost of defense a reasonable starting point? It seems like an offer below that would not be serious.

I'm waiting on a verdict for a civil jury trial (first one) and I want to go snowboarding tomorrow. They deliberated from 9-5 today with no verdict. Is it super frowned upon if I zoom in (it was a zoom trial) in a car or on the mountain or a lodge or something? Probably a dumb question but idk if receiving verdicts is a much more relaxed etiquette.
