Can anyone explain meal & rest breaks for California non-exempt and exempt?

Non-exempt employees are entitled to 1 unpaid 30 min meal break and 2 paid, 10 minute breaks within an 8 hour day. This must be provided by the 5th hour or the company will be fined.

Exempt employees are entitled to a lunch but not breaks. This is for salary employees only and in this case the rules aren’t as strict and there aren’t any penalties that I’m aware of.

This is such a detailed explanation. Thank you for sharing, OP! Learned something today.

These laws are all screwed up. It's been like this in California for years! Pay them for the 10 min breaks, but not for the 30 minute lunch? It's driven employees of mine absolutely mad before.

Yep, move out of the state as quick as you can.

I'm currently the Staffing Specialist at my company. I've only been in the field and in my position for 9 months and plan to take the SHRM-CP test in the fall. While I feel confident in what I do, I don't feel so confident in my overall knowledge of HR.

My VP has budgeted for me to receive study materials about a month before the test, but I personally need a little more time to study as I get test performance anxiety. Do any of you have any inexpensive suggestions for study materials?

Looking for advice on personal space in a relationship. Been in thus relationship for 6 months. I date here and there but have not been in a serious relationship in a long time. Been working late M-F since COVID started. I usually call my gf after work or before I go to sleep and we talk for an hr or so each night. And on Fridays I go to her place right after work and stay the weekend. I’m finding a lack of my own time because it’s either work or her throughout the week and weekends...

I’m an HR Generalist. My job is a mix of recruitment and Employee Relations. I find the recruitment aspect to be pretty enjoyable and stress free, but the Employee Relations aspect does often give me a lot of anxiety (I’m a very anxious person to begin with). Recently, it’s been worse because I have several ER cases currently that seem like they could be potentially turning into lawsuits. Do others in ER experience these anxieties? If so, how do you manage them?

Recently 1 of my clients initiated open PTO policy. The transition from set leave balance to open was smooth process. However we are running into dilemma of how we standardize different types of leaves and whether there will be a limitation to how much open PTO is used at one time. For leisure, we just limit taking two weeks max at one time. However if we have volunteer policy or bereavement policy how should we standardize it? If EE is out for longterm sick, how do we standardize time paid?

So, a recruiter gave me feedback that my lack SPHR or SHRM-SCP is causing my resume to be knock out by AI and human recruiters despite my position and work history in Multinationals and being in Technology. They suggested that we put SPHR ( Lapsed). I let it lapse in 2017. What is your opinion? Plus if I were to take another certification - should I take SPHR or SHRM-SCP?

I'm working in a company that I like, but I'm been quite underpaid. We recruited a new recruiter with a salary 25% more than the one I'm in. I've been approached by other companies, but I wouldn't like to leave, the only reason I would consider moving to a new job is the salary. Should I be open and discuss it with my LM? The formal salary review process is approaching in 2 months, but no way I could get a good salary increase in the formal process, I believe the max could be 6%-7%.

USIC website says “The ID document listed first in List B does not have to be a driver's license - it can be any government-issued ID card, even a parolee's ID card if the date of birth, gender, height, eye color, and address are on it.” But it’s a certified FORM not ID card. Thoughts?

New/pivoting into HR! 👋 Currently working as a TA Coord with a little entry level work in HR Ops prior to this. Is there a SHRM link, reliable test, or method of shadowing the various parts of HR that will provide a sample of the work, thinking, and day to day experience of each group? I didn’t go to school for HR and therefore haven’t had the opportunity to sample HR Ops. vs. TA vs. Comp vs. Benefits vs. Payroll, etc. I know work experience is the best barometer, but what can supplement this?
