Rising Star
Before Tier 2: Only for non EU countries with a cap of 22,000 per year (if applied from abroad). Also switching employers requires a labour market test (advertise job positions for 28 days to prove no suitable UK/EU work eligible for the post) and was much more difficult for companies to sponsor
Now: EU/Non EU at par. No Cap on number of visas issues and no labour market test. So switching from one employer to another is much easier and only requires an offer in hand
With both , you can apply for British Indefinite leave to remain/Permanent Residency after 5 years (+1 more for passport)
In Summary, much easier to change employers and get sponsored with the new points based system vs the older ‘Tier 2’
So if someone switch from Tier 2 to skilled are they still eligible for ILR from 5 year route ??
