Would it be considered a gap even if you have an approved H1 petition for the next company?
Yes you can - as long as you have an offer in hand, I think. I remember doing it a couple of times before I settled at Pwc. That was sometime back, so not too clear on details. But I did take a 2 month break and take off on a world tour before I came back.
No. Is there a reason you want to do this?
Only weekend gap is explainable to USCIS.
My current employer might ask me to leave immediately without completing the two week notice after I resign.
I would think the 60 days grace applies here (assuming your I-94 is current)
If D is your current employer then they do understand H1 issues completely and should allow you to complete two week notice period. Unless you are really in bad terms with PPMD or HR.
Yes you can...
As long as you get a pay slip every month, you should be fine
I did it twice with a gap of 1 week each time.
Protiviti1: no body is going to stop you from taking break. The problem might arise if USCIS sees this gap and thinks you have not maintained status and issues RFE or worse denial. Hence people here are advising against it.
One must be able to show payslips. That is the only way to show you maintained status in USA.
Remember this only matters if you are physically in USA.
You can resign from company A , go back to home country, land in 2 weeks on new company I797 and join new company. No issues there.
