H1B doesn’t need the intent test. You could have immigration intent for H1b no issues. F, J, B visas usually have the immigration intent test.

You can apply without any issues but chances are pretty slim. When is the lottery diversity visa this year?

I’m new to the immigration practice, and recently submitted an I-129 for 15 H-2B landscape workers. I knew the deadline would be close, but I convinced the client that we could take the chance. The cap count was reached after we submitted, so no approval. Is there any other avenue to bring over those workers or is he screwed?

Is QEF inclusion dividend or not? Sometimes, I see QEF inclusion reported on Line 11i and sometimes on Line 6a. I think we can rely on Sec. 1293(c) but I think it’s not foolproof. My hunch is since QEF regime is tailored to treat the PFIC similar to domestic mutual funds, we should not treat the QEF inclusion as dividends. Any help is appreciated.

Wanted to understand what happens in FAANG companies if H-1b visa runs out and there is no I-140 in place to extend visa beyond 6 years. Do they transfer the employee to a non-US office E.g. Canada? Does anyone here been through this scenario?

Anyone who has/ heard of fbookers who successfully switched roles and gotten a promotion (L3 to L4)? Context I am planning a switch from analyst to data scientist from a non US location to US. However, L4 is needed for this jump (prob due to visa issues). With the current revamp in PSC cycle, I am not sure if I can successfully get promoted by next year and make the jump. Good Morning. Here's my dilemma. I have an approved H1B application which got picked up in 2019-20 lot and approved in Jan 2020, before the world went into lockdown. The stamping process was initiated but it couldn't complete as the USCIS offices were shutdown die to the pandemic. I have watched patiently about all the regulations Trump Administration brought in to deny any entry to H1B applicants who weren't already working in the states or who were waiting to return.

So something that I hate is how districts list the teacher to student ratio. My school is listed 1 teacher for every 14 students. Ha! I’ve had 30+ students in 5 class for 20 years. I don’t think they should include professionals that don’t work with kids everyday.

My parents have off the books debt with some people I don't know. They are in a "payment plan" that brings their balance to 0 by 2023. AFAIK it's not a life threatening situation. I've made the conscious choice not to see them until the debt is paid. Asking for opinions on what others would do in this situation. Historically I've already helped them pay a sum of 20-30k the past 10 years. And I made this "selfish" choice so I can start financially planning for my own life.
