Nope, it will fall under discrimination over medical reasons. Same as firing you for having cancer
I would say it depends on your state location and how the partnership is structured. Technically, medical marijuana is still illegal, since federal law trumps state law and at the federal level, it is still against the law, even in medical cases. So technically, anyone can be arrested and charged for possession by the federal police department (FBI), if caught with it, even if prescribed. This isn't likely to happen, but it could. Hence, I believe you could get fired for acts discreditable even if legal in your state.
It’s complicated, technically no, but if you are only working on government contracts which require drug testing and they can’t reassign you then they can since t is still illegal federally.
Can you be fired for using marijuana without a prescription, you know, because it settles you and basically without the herb just fuck it. Asking for a friend in the Denver office.
Pw1 is a real asshole. People do take it for very valid reasons. I know someone who has rheumatoid arthritis and medical marijuana is effective at suppressing the pain unlike the numerous medications taken before it. I get it it's illegal. But when someone's way of life changes dramatically, you can't just say, oh suck it up moron. Especially when someone has to work 10-11 hour work days. Also people should educate themselves. There are hundreds of variations of medical marijuana. Medical contains a much higher ratio of Cannabidiol then thc. Meaning you won't get high with medical. So someone could take it at work for legitimate reasons and you won't see any sign of them having taken it.
The answer is yes. It's still against federal law. In proactive, probably not. Unless they're looking for a reason to trim the work force. Would make riffing you low hanging fruit.
But having a prescription doesn't mean you can be high at work
Having a prescription means you take the medication in the course prescribed by your doctor to prevent worsening of a condition, potentially leading to death
Just because a doctor prescribes it, doesn't make it legal. It is still a crime to smoke weed. And don't get to crazy with your medical reasons, might it help alleviate nausea, etc? Perhaps, but it certainly doesn't "cure" anything and not taking it will not lead to death, lol. And it's still a serious carcinogen. I personally think people who smoke are morons, and I wouldn't want someone that dumb working with me, but whatever.
