D is potentially evading service but is represented by counsel. Counsel has been radio silent after filing lawsuit. Is there any way we can get counsel to accept service?

In fed court, you can file a motion for alternative service to serve the lawyer by email.

CA. You have to be willing to accept and sign an acknowledgment and receipt.

We could potentially file a motion but I was hoping to avoid that since client has limited funds.

Careful with e-serving OC, if you don’t have an agreement they’ll let you know and it’s in the rules of court. No attorney will accept service on their clients behalf. Try sub serve at their work or with a roommate or publication if necessary.

Spend a bit on sending process servers to the target’s possible residences and workplaces, and collect the specifics of service attempts in a declaration. If he doesn’t surface, apply to serve by publication.

Back when the pandemic first hit, everybody at the firm took a 20% pay cut (with 20% reduction in billables...which was meaningless because I still had work to get done in a timely manner). Any of you manage WFH / telecommute more than 50% of the time? When I was an associate, you hardly saw the principal/owner.
