Generally ID is defending the insured against a claim/lawsuit. Coverage is a dispute WITH the insured over whether there is insurance coverage for a specific claim/lawsuit.
Coverage is also 3rd party claims against your insured’s policy
Coverage your client is an insurer, and it mostly deals with combing through a specific insurance policy, drafting letters to the insurer about coverage, filing dec actions in federal court, and getting sued for bad faith (depending on the state) if you make the wrong determination. To me it almost feels like appellate work. Its litigation, but quite a bit different than ID litigation where your client is a real person, there can be tons of discovery alalong with potentially contentious depos.
I would guess most people consider coverage a little more prestigious (they’re going to usually relate to bigger/more complicated claims) and presumably higher paying. On the day-to-day, not sure.
Yea but now you’ll be building relationships with the adjusters and investigators
5th year insurance attorney here. Started in ID then moved to first party coverage and now 3rd party coverage.
ID is usually defending the insurer against a bad faith suit by its insured.
1st party coverage more often than not is the insured seeking coverage from its insurer and you are helping the insurer decide whether or not the the claim is covered. There’s often fraud implication or insured duty issues. Mostly h03 and dwelling policies.
3rd party coverage is when you represent the insurer and there is a 3rd claim against your insured. You are advising the insurer whether they have a duty to defend against the claim and whether there is coverage under the policy. Mostly CGL policies.
3rd party coverage also has a litigation aspect where you are defending a third party claim for coverage against your insured.
Coverage is more prestigious than ID and 3rd party coverage is usually where the money is.
Hey there! Trying to learn more about first/third party insurance litigation. Any resources you’d recommend?
