Do you wear a suit and tie to depos? I’m a young attorney who has only done a few depos, but every time opposing counsel is male, they are not wearing a suit, usually like a polo or a shirt (not tie or jacket). Is this the norm for Zoom depos?

I wear the lawyer uniform to all lawyer performances.

likefunny

no, zoom depos have become more lax. I would say suit and tie for zoom court, but a shirt is fine for a depo!

like

Some partners in my office disagree with this, too, and have done zoom court status conferences in a polo/nice shirt with no tie.

like

Concur with A.

Zoom Depo is business casual. Have had in person depos where other attorneys are super casual- but they are highly respected. Also depends whether you are taking or defending, and your client’s expectations.

like

Yeah. Depos are pretty relaxed as far as dress goes, and so are arbitrations, at least as far as I've seen around here. And I'm glad, I hate our societal traditions that pointlessly mandate uncomfortable dress in certain situations. So I'll dress more comfortably whenever I think I can get away with it. But I'm not brave enough to stick it to the man in court settings, even over Zoom.

like

I think your fear of sticking it to the man in court settings is justified — I watched an attorney get chewed out by a judge for not wearing a tie to a zoom CMC

like

I’ll go a tiny bit more casual than court, but still with a blazer or just a more trendy suit

like

The client is paying for our experience as much as our appearance unfortunately. So yes, I do.

like

For depositions, whether virtual or in-person, I’ll wear a suit with no tie. Even in a virtual environment I think it gives off a good impression to your adversary and the parties if you’re dressed well.

like

You’re not the one being filmed. Learned that from opposing counsel who’s a super star trial lawyer and showed up in a Steve Jobs turtle neck and jeans

funny

Button down, no tie, no jacket for zoom depos is my norm now. I’ve worn polos before but now prefer to appear a little more professional. I’ve had OC show up to zoom depos in a ratty T-shirt before. I would never go that casual, but to each their own I suppose.

Really depends on the case. Or, potentially, how stuck in the mud the powers that be are about it.

It depends on what kind of deposition it is. I always wear a full suit to my depositions (complex commercial litigation). Even on zoom. However personal injury and toxic tort (lead paint, asbestos) depositions are much more casual. I think because the parties are typically not sophisticated so attorneys feel they don’t have to look the part. I think suits are helpful for commanding respect and demonstrating competence above and beyond excellent deposition skill.

This. Dress for the occasion and for your purpose. If you're a baby lawyer and this is your first year, wear a suit, especially in person Deponents and other lawyers will take you at least a little more seriously if you do. It also helps you look older which helps in his profession.

You're more seasoned and have a few years under your belt. I would dress for who the person is. I take a lot of depositions and very diverse people in insurance defense and I know that an older male may be expecting the suit and tie and could be thrown off with casual wear or may respond better to the suit and tie depending on how aggressive or how truthful I expect him to be. As you take more depositions, it's easier to generalize like this and try to plan your outfit around whose deposition you're taking.

I will also take opposing council into consideration. There are certain lawyers that are very formal and will be wearing suit and tie and some who will come in their white T-shirts to a deposition. You never want to be the worst dressed person in the room, even if that just means a nicer looking Polo or blouse

Suits during deps are beneficial depending on what you’re looking for. They can be intimidating to some witnesses

Are you going to be on video ?

Generally curious how many companies offer phone reimbursement? My last gig did not but the current one does. Legally it seems, all employers are required to do so if we use our phone in literally any capacity (video call, slack, teams, emails etc). How prevalent is the issue of not reimbursing phone dues?
