Yes - I work in funds and for GP-work, there is no real reason not to charge flat fees for initial drafts of the docs.
100% of the work we do is flat fee, unless a client insists on hourly billing. Real estate/public finance. Very rarely does the firm lose money on these, and your realization rates are 100%. Sometimes post-closing work is a pain if all funds have been used
Most of my work is flat fee.
Pros: when you beat the budget, you get a windfall
Const: when you don't, you lose
Patent prosecution and trademark prosecution.
About 20-25% of the retainers I write (Land use and real estate) are flat fee with a clause saying anything out of scope is hourly. The associates I work with hate them because after about 15-20 hours of associate attorney work, the flat fee matters cost the firm more money than they make, and often times the matter isn’t resolved in those 15-20 hours.
Clients love flat fees. Small GP firm and I tell clients straight away what my fee is. They’d rather hear the cost of a legal service instead of the insane price I cost per hour. Not realizing they are the same 😭
Works best with long standing client where there are fewer surprises due to long term relationship. Some small projects for new clients can work out well also.
