A family member did that. He maintained a US address and his home office was Buffalo, NY. So they’d have to fly him everywhere. He ended up getting staffed at a project in Brampton which made life easier for him. But tax wise he had to pay New York taxes and the marginal Ontario tax. Essentially if you’re Canadian, you’re paying the same amount of taxes but you’re earning more, AND in USD. So a lot more overall.

OP, sounds like you are Canadian. Assuming you do not have authorization to work in the USA this is all a moot point... as no one is going to hire you for a US job without proving immigration status

Barring any immigration issues, what's illegal about this? If one can legally reside in Canada but maintain a job legally in the US and perform it, what's the illegality here as long as they are paying the correct format of taxes based on the jurisdictions involved? I would think this would be more of a company policy issue rather than a country related issue.

I was thinking mostly about taxes, and also whether a client is aware work is being done cross border.

Firm won't let you do that due to tax implications for the firm. Different if you're independent or with a consulting agency that doesn't mind - but none of the big firms will do it.

I’m sure this is illegal, but I’ve seen people use a US address and work from Canada.
These days not very hard to tell where you physically are... so not recommended...
I know someone that’s in this situation, but the company infrastructure was set up to accommodate. Essentially, they have an entity set up in Canada from which he receives his paycheque in CAD. His salary is effectively a USD - CAD conversion.
Of course there are tax implications. Even if you work in a different state remotely there are tax differences. However, it's very hard for them to track where you are. From my experience even if you're connected via VPN abroad, as long as no one knows that you're away, no one will question anything. So assuming you have a visa to work in the US for a remote gig and have a US address, you can simply work from Canada the whole time and no one will know.
Ah thats a good point sc 1. Forgot that even a Canadian with a tn1 visa may not be able to leave the country as freely as an American
citizen.
You can if you are Independent Consultant or Consultant (1099) but if you are on W2, it’s hard to keep that going for years. For a few months? Maybe.
It’s possible to do this if you have a compelling reason and your project PPMD and client agrees to this. You need to pay taxes in both US and Canada depending on your immigration status in Canada. This is also more of a temporary thing where you may get permission for 3-6 months but not a long term thing.

OP, are you authorized to work in the US?
