Does your firm make you sign a contract when they start your green card process? My firm asks to pay back costs if i leave before I get my green card approved. I am Indian and wait time for EB2 is like 15-20 years

We charge at cost. Usually with attorney fees around 10k

like

10k sounds reasonable from what I have found out. 35k seems too high

like

Yup I signed one at my bank. The agreement was to stay with the bank for 2 years after green card is received or pay back costs of application 50% if leaving before the end of the second year and 100% before the end of the first year after receipt of green card.

like

How long did it take to get the green card? The reason I am concerned is because it takes 10+ years. Not sure if I could/would want to stay that long.

What are the costs? Negotiate those costs as a sign on bonus with your new company.

20-35k. Thats what i have in mind too!

Sorry I did not answer the contract question. If you do sign the contract, have a plan that you can pay the costs before you actually sign the contract. Have the costs well documented and ensure that they are reviewed by an immigration resource so that your company does not inflate the costs in the contract.

That sounds a good strategy. I have heard big banks have a predatory process when it comes to filing green cards for employees. I know friends who signed similar contracts with non banking firms where costs were less than 10k

like

I wonder how long a contract like that could actually be valid for. I'd ask for a realistic cut-off time on the agreement.

It says till the green card is processed, which my case could go as long as 15-20 years. It sounds ridiculous!!

like

These contracts only till I140 is approved or maybe 2 years post that ... Inquire what exactly they mean by green card

That could be the case. Thanks for pointing out. I’ll check with them

Many times the companies do not enforce these clawbacks.
I had moved after my I-140 was approved and although the admin made a lot of noise about how they had paid the costs and I will have to payback, the actual money spent was less than $4000. It was nothing significant and eventually the dept absorbed it.

I wouldn’t worry about this contract.
The major chunk of costs come for filing I-485 and you wouldn’t leave once that is filed anyways.

I get your point now

Yes, even if I’m fired.

Hmmm ok

Wait, 15-20 years?? That's so long

Yes. Waiting for EB2 Green Card for Indians is in that range.

That’s usually the case but your hiring company usually entirely or partially covers it

Thanks. That’s helpful!

Gtfo of that company

Pretty much all banks have similar policy.

like

Yeah I've done something similar (US to UK) - we agreed I'd pay back costs, but on a sliding scale so the longer I stay, the less I have to pay
