Firm had return to work with no safety measures at all. Masks not required. Employees eating maskless in lunchroom. No policies regarding staying at home if sick, etc. Firm has Covid-19 out break resulting in almost 30% of firm infected. People still showed up to office without quarantining and still maskless. At least 1-2 of those people ended up positive. Now, firm has sent email admonishing safety outside office and only instructing people to stay home if sick and if sick enough to warrant

If you are going to voice what seems like legitimate concerns, do it in a way that you would recommend a client do it. Note your concerns, about lack of policies/enforcement to ensure conformity with public health guidelines. Be professional and clear about the relief you are requesting- e.g due to lack of guidelines and prior outbreaks you do not feel comfortable working in office - you will be working from home until further policies are established, please let you know in writing if you have an issue with this and you will be happy to discuss. Hopefully you are not the only one who voices concerns, and the effort will force them to adopt better practices - if not it will create a record and signal that you are aware of and preserving your rights should negative employment consequences occur.

I cant believe I'm the first to say this, but get a doctor's note to work from home immediately. Most healthcare practitioners will give you a note that recommends full WFH status without even needing to explain preexisting conditions at this point. You are absolutely right to be cautious about returning to your workplace, but you shouldn't have to give up your job and financial support right now to make a point or stay safe.

I dont plan to report the firm to any authorities because the firm could be negatively impacted. I hope we will implement safety measures that will lower risks.

We must work together! My prosecution office was similar. But I couldn’t speak up because the Republican I work for thinks the survivability rate trumps everything. I went back, air purifier in my office, I wore a mask etc. I’m now home with Covid. I am so sorry.

Research other office “return to work” policies; prepare a suitable one for your office; bring it to the most receptive partner. Say you are concerned with the health of your coworkers and self, explain you checked what other offices are doing and thought it would be helpful to put together a plan for the office. Generally good leaders prefer solutions rather then complaints.

C1 - I tend to agree with you that employers should be concerned with health and safety, but I also know that sometimes it takes a catalyst for the change especially with smaller firms that do not have designated managers/hr. Too often a partner/shareholder is too caught up with being an attorney instead of developing good hr policies. We see it all the time with training, management, etc., all of these things are vital to a well run firm but as we all know they often are overlooked or ignored. But given the stakes involved -illness/death even the most recalcitrant firm leaders will begrudgingly implement policies if for no reason than to limit liability.

Been there, done that, and decided to leave the firm. They had no problem cutting our pay at the first mention of covid back in March, but wouldn’t allow us to work from home even though we had full remote capabilities and employees who actually got the virus, and partners who kept having to quarantine because they were getting exposed to covid at in person meetings. No protocols other than sending emails suggesting we wash our hands.

There are federal laws that require your firm to pay for quarantine time if you have symptoms and to pay if you or someone you are required to care for (ie. parents or children) are sick.
