In my experience, conflicts happens after either an offer is made, or once they know they want to make you an offer. I think it’s kind of a waste of everyone’s time to do it earlier.

Yes. Depending on your area of practice, you may just be giving them a list of clients to poach.

It can take a while to complete the conflict check process (especially if anything needs to be cleared), so it makes sense for them to ask now if : (1) They want to be in a position to extend you an offer, and have you accept, soon. They may have an urgent need for your skill set and don’t want to delay your start date any more than is strictly necessary (as you won’t be able to give notice at your old firm until you clear conflicts at the new one). Or (2), you’re in a jurisdiction or field where one of your current clients may be a deal breaker. There are major companies in a few industries (think tech wars) that bake requirements into their engagement letters to say that walls are not enough and they will not sign conflict waivers. It makes no sense to waste your time (or the firm’s) if one of your conflicts has the potential to eliminate you from the candidate pool. Just remember to check your jurisdiction’s rules about disclosure of client relationships, and when in doubt, call your bar’s ethics hotline for help. Last time I went through this process, nearly half of my entries were styled as “Confidential Client - Mid-size company in IndustryX: Provided advice on potential litigation related to an employee. No active matter filed.” or similar.

I just did my first lateral move too. They also asked for my case list for conflicts prior to making the offer. However, I was made aware that the offer was coming. I provided the information but only for a few clients that knew what was happening and held off on the rest. I also had the same thoughts of it potentially being a waste of time.

Also, may want the client list for conflicts done now because depending on how long youve been with your current firm, it may take a while to draft. Have it ready.

I work as an implementation consultant and my work is highly industry specific, utility billing for municipalities generally less than 20k accts. My position does not require any technical knowledge, only that I know the software well. As I look for other jobs (more just curious and not actively applying) I see that I am not a fit for much out there. Does anyone else hate the interviews that you think have gone well, but then you end up being ghosted? I thought I did well because the interviewer told me I would ‘fit right into the team and team culture’ and said ‘keep an eye on your email, we move quickly and you’ll probably hear about next steps in the next few days’. After 3 months of applying I some how got an interview with a well known growing tech start up! Interviewed and got an offer this week. Unfortunately the offer is lower than my current comp with 1 yoe but it gets me out of tech consulting/compliance and into a pretty interesting product facing role!
