Can you say you left a consulting firm if you were laid off? There’s no real way to confirm. All my employer would provide are the dates I worked there. Thoughts?

Confused about long term capital gains tax rate - are the brackets for how much capital gains you make in a year, or are the buckets determined by income? Ie. If my income is over 40k do I pay 15%? Or do I only pay 15% if I realize >$40,000 in long term gains in a year?
