Friend was terminated from regional CPA firm after 6 years. No severance whatsoever, only paid out for accrued PTO. Does he have a case for legal action?

Severance is not a right in the US

This firm terminated others recently (with MUCH less tenure) and while they did not pay them severance, they gave them two months to hang around and look for a job, while still on payroll, and they stopped performing job duties at that point. But my friend was given two weeks to finish his work and then sent walking. When he brought up the disparity in treatment, the partner told him it was b/c the firm "had a bad year". I've never heard of a firm this size treating someone this way. Am thinking PwC1 might be right...

Tell your boy to lawyer up and sue them. A decent lawyer may be able to trump up something and get a settlement.

Most of us in PA are employees "at will" under the law. That means we can quit when we want and they can terminate us when they want. I doubt there is any legal action to obtain severance payments for your friend. Sucks.

OP, I understand your frustrations. Yes, he can check with a lawyer. He may not have much of a case. It depends on the state laws (most are employment at will). In the same time, was he a high performer, how were his reviews? Also, can he make a clear case that he was treated differently from everyone else? If Yes, he may have something. However, don't put your hopes up. In US employers have a lot of power. Hope your friend can find a good job soon!

Thanks CH 1. Yes, he was a high performer, 3 advancements and good raises each year. Was never given a performance review in the year leading up to termination. Then at year end fired with no warning. However, he had made it known he was looking elsewhere (I suspect the reason for termination...) IN is an at will state so probably no recourse.

It's bad form on the part of the firm, but probably legal. Severance is limiting liability from a firm standpoint, in that the severed aunt getting it if they don't waive all present and future claims.

Which firm was it?

Unless he can prove the treatment was discrimination against one of the protected classes he's got no case

Collect unemployment?

Yep unemployment is in the plan if he doesn't land something soon.

Was he laid off or fired for performance specific issues?

He was fired, not meeting expectations. They saw no future advancement for him despite having a solid performance history from a technical standpoint.
