Got a retention bonus at the beginning of the year that paid me the full amount the day i signed it and i thought it vested every month but i just found out i have to pay it back in full if i leave before year end. Been interviewing for a different company that i think I’m going to get an offer for. Has anyone negotiated a way to keep this bonus even if they leave? I own a lot of internal processes/projects at my company and if i leave with only two weeks notice they’d be screwed

Isn’t it called…retention bonus? I feel like you will have to give it back but probably different by companies. Also…not sure which company it is but I personally don’t think anyone is irreplaceable, I.e. they will have a rough ramp up time but won’t be screwed

It’s not uncommon to ask a new company to match a bonus you’ll lose if you join them.

Yep, this. If the new company wants you bad enough they will supplement this loss to you for joining them. Of course you have to pay it back, that’s what a retention bonus is! They give you money so you agree not to leave. You are luckits just a year. My current company has three year agreements on retention bonuses.

If you tried this maneuver at my firm, I’d make sure you don’t keep a dollar of the bonus, prevent you from ever working at the firm again, and never give you a good reference.

Character and network are everything. Not a good look to erode both early in your career.

Given the current economy, you're most likely going to lose the bonus the second you give notice. Use this as a lever to negotiate for a sign on bonus to cover (and hopefully beat) the retention bonus!

Legally, the company you currently work for can and will claw back your retention bonus. It may not fully be clawed back though, depending on the terms of the agreement. You may be entitled to keep 50-75%, but you will need to cover the taxes that were given as part of the payment to you.

Again what did they tell you when they gave you the bonus? Did you sign something before you accepted the bonus that said you have to stay a year or you have to pay it back? Did you sign a policy before they gave you the bonus? Or did they just give you the bonus and you started and never signed anything? Because if you never agreed to anything and they just gave you the bonus without any terms and conditions, then it will be hard for them to prove that you knew you had to pay it back if you left before year. A lot of companies sometimes do not want to go through a whole process to get you to pay back the money as well. It might cost him more than just to let you keep it.

Had a family member go through this recently. They were able to keep the bonus because the company didn’t have the leverage to force her to pay it back and it wasn’t worth the costs to litigate over it so they basically gave up. She obviously burned some bridges but thought I’d share that anecdote. Sounds like your bonus might be more substantial though.

I’m a 5th year in Philly. I’ve jumped around a bit, I’m at my third firm. I have really good experience, a few jury trials, tons of deps and arbs, and recently worked on two class actions and an MDL.
