I am on notice period with Tata Consultancy with 2 months remaining with an offer in hand where the joining date is just after notice period ends. Now, I got early release from current company and thus, I saved 2 months. But I want to use these 2 months for travelling, upskilling and looking for better offers instead of contacting the new company for early joining. So, if I join the new company after 2 months will this be considered as a 'gap' in my profile in the future and will it be harmful?

Nope .Remember green card is for future employment . Just remember if you have used 6 years of H1-B ,you need a pending green card application for future visas
Thanks EY1. Probably I should have provided bit more background. I have already received my I140 approval notice and we plan to move out of US for at least 5 years (so I won’t be employed by a US employer during this period). In such a case what happens to the GC application. Is it cancelled ?
if you move out , you are no longer employed in US. if it’s employment based gc , then my understanding is that it gets null and void. i could be wrong , check the sheela murthy forum. they are pretty good at it and it’s free
I would still think you can do consular processing outside of the US and maintain your priority in line? Could be still wrong...
Consulting an attorney is perfect .This is what I know .Your I140 cannot be revoked based on new rules .This means if and when you want to come back to the USA,Any employer can file for H1B for 3 years based on the I40 approval .After you come here ,You will apply for labor again,Then when you apply for I140,you will port the old labor date and probably get a green card immediately .Hope I am making sense.Typing on a plane waiting to take off 😬
Best to consult an attorney. And please update it will be helpful .
OP please keep everyone updated
Thanks guys. EY1 - I didn’t know about that clause! Will keep everyone posted as I find more.
Interesting. Even I was unaware of this option. Always thought that gc is considered abandoned if you're out of the country for 6months.
Guys, you can be out of the country for max 2 years with some x min days in the US to ensure u keep hour GC active. This is based on an attorney chat last year, pl check with the experts
