Yes. There is a limit to what you can change but it’s possible. Severance is negotiable as it’s not part of a contract. In fact we have no contracts in the US, just at-will agreements. My agency laid me off and wanted to pay me a week for every year I’d been there. I was 3 weeks shy of 7 years. So I assumed that meant 7 weeks pay. It didn’t. They wanted to give me only 6 weeks, claiming the holding company wouldn’t negotiate. So I lobbied HR and senior management (called and emailed), explaining the situation was unfair. They had chosen the end date so I questioned whether it was to avoid one extra week of severance. I held off signing my separation agreement until I was promised 7 weeks in writing. Remember they want you to sign that agreement to avoid any court battles later, so that’s your bargaining power. ACD OP: Have you been laid off? What are you trying to negotiate?
Sure! I got 2X severance and letters of recommendation once. You have a bit of bargaining power there, not much, but usually there's an agreement they want signed that you can leverage, and of course everyone wants it to go smoothly generally. Don't overplay your hand, but there's typically some wiggle room here.
Yes. Try asking for things like additional COBRA or extending your health coverage. Put your request in writing. Be polite and detail the contributions you’ve made to the agency and why you’re asking for whatever you’re requesting. It can be hard to get additional severance pay but it can’t hurt to ask.
I got my non-compete significantly reduced.
I had 5 carryover vacation days that I needed to used before the end of March and had booked time off to do so. They laid me off right before. I negotiated those 5 days along with my unused vacation days from that year.
I reviewed my severance agreement with an attorney, he helped craft the response but it made no difference. The response was that the company wasn’t making any concessions due to the amount of people getting laid off.
