Oral contracts are still contracts. Sue, but don’t sign a confidentiality clause.
My prior firm tried to do this once they realized pushing me out meant I would become a competitor. The owner tried to attach conditions to the severance after I accepted it (like that I had to agree to move away like I advised I might do since they were pushing me out). I advised the owner there were no conditions discussed as a requirement for my acceptance. I also advised the firm would need to agree I was fired if the severance was being revoked so that I could get unemployment benefits. In the end, I received the severance without conditions. I own my own firm now - running it the way I want to. That whole incident sealed the deal about me not feeling bad about becoming a competitor - and not feeling bad about referring cases I could have referred to them elsewhere.
I didn’t reach out to an employment attorney since it was resolved, but I recommend you at least talk to an employment attorney to see if you have recourse or can claim any type of discrimination, etc. You are probably not thinking completely clearly because you are feeling deeply betrayed. So, get that outside perspective from an attorney who knows this area of law.
