Your extension with the current employer and transfer to the new employer are not linked. You don’t have to discuss it with your the current employer at all. Your new employer will file for a transfer, you will know in 2 weeks (if premium) if it is approved and then you quit. If it takes more time then the extension with the current employer keeps moving.

Accepting an offer and officially joining are two separate things. You can sign the offer but not officially start unless the visa transfer is successful and usually the new employer can file the extension as part of the transfer Source: doing this right now

Your current employer or lawyers will not know about your transfer petition. Also, you run a risk of your current employer withdrawing extension petition if you tell them about your plans to jump the ship before your transfer petition is approved. Hence take the advice from others here, do not tell your current employer until your transfer petition is approved. Once transfer petition is approved, you can resign and negotiate joining date with new employer

That’s reassuring to know! Only issue is if I tell them after signing and they come back with a better offer… don’t want to be in a situation where I’m rescinding a just-signed offer

Hey OP. I was in the exact same situation as you. H1B expires in September. Company “started” H1B extension in Feb/ March. Interviewed and got an offer from an external company in April, accepted and went through H1B transfer which got approved in June. Talked to current company, they counter offered and I accepted, and then H1B extension got approved last week.

The transfer was approved and valid till June 2024, the extension was approved and valid till July 2024. It’s basically 3 years from when they submitted or applied.

Yes, I did this last year. I accepted my offer at the new firm but didn’t say anything to my old employer until my H1B transfer was approved.

Im on an H1B at Deloitte. I want to move to the Dubai and have been getting some traction with two different consulting firms. I’ve used less than one year of my first H1B. If at some point in the future I want to move back to the US will that count as a new petition or the sponsoring company with which I’ll get a job can file a transfer petition and get me started?

I’ve been going through a tough phase at work and health wise and I’d taken an Leave of absence and I’ve been working with my therapist to deal with it. Everything was going okay up until my therapist lost her cool and yelled at me and called me names for wanting to extend my leave. She spent half an hour of the session just name calling and yelling at me and I’ve been pretty disturbed since then. Whatever her reasons may be, I do believe that her behavior was completely unprofessional
