Lately since the reopening I have put the court reporters address and require them to appear in person while the attorneys appear via zoom. The court reporter sets up the zoom in their office with masks and social distancing. This has worked and allows me to get at least get a CNA if they don’t appear. Otherwise my subpoenas have been ignored.
I would just put "oral deposition in person or virtually as agreed by the parties" or something like that.
In addition to ticking off the correct boxes on the subpoena itself, I include an attachment explaining that the deposition will proceed remotely via Zoom or other appropriate platform.
All of my zoom subpoenas have been ignored.
I state that the deposition will occur via Zoom and then write something along the lines of “upon receipt of this subpoena please contact [firm name] to provide an email address for the zoom invitation to be sent.” I have sent out about 4, only two responded.
I’ve done this about 25 times so far and this is what I have put in the subpoena, “[person’s name] is commanded to be and appear and give your deposition in the above captioned matter by remote video conference on [date & time].”
