You should already have a well-documented performance plan that illustrates where they did not meet expectations, your conversations with them, and their inability to improve. Ignoring D1’s asinine comment about “DEI police,” they are right - we’re in the customer service business. That being said, it’s incumbent on you to make sure the client isn’t actually being discriminatory - if they want a woman off the project because she’s bossy, or someone born in another country off because their accent is somehow too hard to understand, our job as leaders is to lead and take care of our people.

That’s unfortunate. Keep in mind that something may have been apparent to them that the internal team didn’t see. If I can make a suggestion to avoid this moving forward: coach and give as much continuous feedback as possible. Different groups have different ways of operating which can clash, but people can learn.

One of my good friends got accused of racism and gender discrimination because he didn’t extend an offer to someone who worked for his team on a 3 month probation. The accuser didn’t have any evidence when HR tried to investigate though.

Perhaps you can check yourself and the client for signs of discrimination or unconscious bias. Are you assigning work that plays to strengths or highlights weaknesses? Are you holding people to an equitable standard of performance, based on their relative strengths and knowledge? Are you assigning more revenue-generating work to men than women? Is each teammate being set up to succeed or are some being given critical guidance while others are heavily isolated? Does the teammate have a clear understanding of the expectations or is there a major incorrect assumption being made / communication breakdown? I've seen many team leads say and do blatantly discriminatory things behind closed doors and influence clients to think badly of teammates. I stare blankly at them when their team performance inevitably tanks because of it and they complain about what they have done to themselves. At the same time, I have never seen the same bad behavior in this specific aspect from any client and have never witnessed an actual report from a teammate. In this day and age, to actually make a report is a sign that something serious is definitely going on. It could be with the teammate's performance, someone on the broader team who is a gossip and drama creator, the client, or the team lead. However, it is also a testament to the intention of the teammate; if they are actually fighting for their position- it means they care to do their work deep down and are not afraid to shake the boat even if it puts their career on the line. The ones who don't fight you to your face are dangerous. I would wait for the explanation around the nature of the discriminatory actions. Chances are they might be of substance, but I have also seen people be wrongly accused, so you never know. Evidence is king here, as someone said.
