Have you ever ended a deposition due to harassing/inappropriate conduct by OC? I was close to it today and want to see if we were in the ballpark where it was justified.

I have not personally but a partner at my firm cancelled a deposition because OC, who thought he was muted, made some comments about the deponents race. Partner said the comments made deponent uncomfortable and the depo was cancelled. The deponent may have helped the opposing party’s case but never actually tried to take the deponents depo. I think the case was settled for nuisance value.

Details: deponent was an independent fact witness, low education, ESL (but spoke good English). She was answering all questions, not avoiding anything. Opposing counsel was belligerent, aggressive, accusing her of criminal conduct, said she was lying in front of her off the record, had her at tears and at the point where she wasn't comfortable even going to the restroom during the break on the same floor. She asked the court reporter to walk with her down to the first floor restroom instead.

OP, I would leave it. Next time ask the witness about what the lawyer did off the record. But I don’t think this is close to terminating the deposition.

Yes. Make sure to create a good record and give opposing counsel an opportunity to self-correct. My state rules, like the federal rules, allow for suspension of a deposition for purposes of seeking a protective order.

Advice to avoid ethics violations and unauthorized practice of law in the following scenario. I am licensed to practice in PA and live in PA. The amount of people, even attorneys, who can't separate out the policy merits of abortion from the issue of whether it is a constitutional right is disappointing. I consider myself pro-choice ---I believe states should allow it, that the federal government can pass a statute to guarantee it, and that FDA statutes and regulations will preempt any state trying to ban chemical abortions through FDA approved drugs. Dobbs at its core is a case about the Due Process Clause, not the policy of abortion

Whoever said employers don’t care about grades and transcripts after your first job was a liar. Every lateral position that I’ve applied to as a 3rd year has requested transcripts. Why do we lie and tell grads that employers don’t check transcripts when they do. My coworker, a 5th yr, had to submit his transcripts also to lateral job. Side note - it speaks volume when multiple associates are trying to lateral at the same time
