Very common in tech. They’re practically unenforceable though.
This varies tremendously on a state by state basis. In California for example they are essentially meaningless, in NC or FL , they can be extremely burdensome.
My understanding is they’re only enforceable if they pay you - that’s what Citadel and 2 Sigma do
Yes there’s a clause about that included - they will pay a portion of salary for the 1 yr
Two Sigma and Citadel have it. It’s also enforced nearly 100% of the time
Non-compete are the hardest to enforce. Depends on the context in what you’re doing but you’re likely ok if not a direct competitor or client.
I signed a non-compete but it said same industry. Luckily for me I was moving from industry to B4 and the “industries” are technically different.
I guess it depends on what you actually signed, and I can’t speak directly to Bain, but most organizations don’t care enough to pursue them. Much less that they are challenging to enforce. It’s mostly an ass covering thing.
How do they “force” you to sign it? They can’t make you do something if you’re already out the door.
I know a partner that left a big 4 and had to sign a non-compete for an entire geographic area
