The new company started the process all over again and she got her i140 approved, but we realized they filed it in EB3!! Her priority date is current in EB2. Has anyone been in this situation? She was really hoping to file for i485. Is there anyway this can be remediated?

Deloitte onboarding E-mail says , it background verification is not complete by target start date , they can postpone the date last minute.
I have 14th march as a start date and I don’t know my background verification status.
I emailed BIONBoarding but no response.
How am I supposed to give notice to my current employer without knowing BGC status ?
Please advise if someone faced this situation.
(P.S. I don’t have any record, just being cautious because I am on H1B/work visa)

Anyone here switched jobs after I-485 approval (and before getting your green card)? What was your experience?

My H1B is not selected in the second lottery. The next lottery is the only option of getting selected. My STEM-OPT will expire in May 2023. I have some questions 1) If H1B gets selected will I be able to work till October 1st (which is when H1B status gets changed) ? 2) My wife will file her I140 in Feb 2023 can she also file H1 EAD along with it? 3) worst case scenario should I enroll in for day 1 CPT program?

What are the chances of a H1b change of employer getting rejected. Moving from a EY to Mastercard. Considering the reputation & size of the two companies it should be smooth right? Just nervous and want everything to go right.

Got an offer for a job that starts in the summer (Jul 2022) and the firm is willing to apply for the H1B lottery. Since I’d have two entries (McK + other firm), what happens if the McK entry gets picked up (assuming the other firm isn’t)? Am I correct to assume that I’d have to stay at McK atleast until Oct 2022? Or can the other firm formally apply for my H1B instead?

How does H1B unused time recapture work after leaving the USA?

I am on h1b with an approved i140. Been on h1b for more than 10 years. In this last h1 renewal I have about 1.5 years left.

If I leave for India now, can my employer H1 cap exempt petition to recapture the unused time? Does it have to happen within 6 years of leaving the USA?
