I have a written offer and would like to start on 1/11, which is the effective date of the offer letter. I told them prior to receiving the letter that I would be able to start 1/4. Would asking to start 1/11 be a poor decision?

I have a serious question regarding this because time is running out. I quit my job last year on Nov 5. I had about two weeks of PTO accrued and I wasn’t paid out my PTO. It was nowhere on company policy other than I was told “it’s known we don’t pay out PTO when someone quits”. Could I file a law suit to get me paid for those accrued hours?
