In my experience there is not usually much flexibility about signing a non-compete The best you can normally hope for is negotiating different terms for clients you originate. If you are interviewing with a competitor I think you need to be prepared to disclose that you are subject to one, and generalities regarding what clients you can’t work on and how much business you believe you could take to the new firm if it were not for the non-compete. As discussions with the prospective employer progress you would normally need to discuss more details regarding the terms.
I don't even know. For #1, I would have to see the non compete. For #2...I would have to see the non compete. What's the repercussion of breaking it? Sorry I couldn't be more helpful.
