You may have to approach it from the stance of providing suggestions with data that backs up changes you would like to see while still preserving the protection of the students under the law while including supports for us who are not as protected.
Advocate to your local state legislatures. That would be a good place to start. Also, speak to your school committee members to see if they'd be willing to fight alongside you.
Thank you. That is where I'll start. I spoke with my principal. Got no where. And then the assistant superintendent. He forwarded my concerns to the Special Education Director who sat me down today and told me that basically there isn't anything they can do because he is a sped student.
Apply for assault leave every time. You have it, but they don’t tell you you do. At least in Texas we do. There may be something similar wherever you are. Just like everything else in education now, they only respond to money being taken. So, take it. Every time. If they throw a stink, document it. If they tell you something in person, tell them you will need it on an email for your documentation records or just document date time what was said by both parties. This is ours here in Texas. Again, they won’t say you have it, you have to look for it. https://www.ueatexas.com/assaulted-by-a-student/
There used to be something for stress leave in Texas law where you got paid time off if you had a therapists note saying the job was stressing you out, but that’s probably gone by now. Otherwise most educators would be on it weekly lol. Even if you get just a scratch, announce you are leaving for the day, getting a tetanus shot, (which you definitely should) then you have a documented injury. It never specifies how severe it has to be. It’s all still assault. A student should never put their hands on a teacher, period. If they are that bad, they need to be in a facility. We aren’t orderlies and we don’t have the resources to handle it (like the sleepy butt shot)
Have you tried speaking with or meeting with the super intendant? I try to keep a close relationship with mine for times like this
What does staff need to be protected from?
Lol we need to be protected from the aggression of some sped students. Yesterday I’m my class a student took off her shoe( in 5th) and hit me in the face with it!!! I was shocked but what can you do!? The parents don’t see a prob! ??
Contact the people in your local offices that makes the laws. Advocate for yourself
Thanks for the info!!!!
