Yep, If you're not a good fit, can't be trusted with clients, bad deliverable quality, untrainable, bad attitude, etc... PIP's exist to put on record the firm tried to help you improve so they can't be sued for unjust termination. Most people don't make it off a PIP.
You might be able to sue, but you'll also come out as a Bernie supporter who believes he deserves money for not being good enough to earn it himself
Right.... Coz everyone is so perfect.
It's not truly that, it may play into it but being late with shit, not taking responsibility for actions, bad attitude, ect
If the firm fires you for "performance reasons" but doesn't give you a PIP (or any documented instances of poor performance), can you sue?
You can't sue if you're in a employment by will state.
When you piss off your manager and they focus on everything you didn't do right to push you out
Successfully sue* I should say
.
EY - the matter isn't the at will, it's the fact that there is no evidence that I had performance issues. They are trying to say this about everyone they laid off so it doesn't look like they're doing so poorly they had to lay people off. But I don't think it's fair that they can lie about me like that
You need to understand at will employment, they don't need a reason to can you
And that's not the problem, the problem is that they're lying about the circumstances... Thus limiting my chances to ever work for another division of the firm, etc.
Then you need to look into a good employment attorney, you may have a case
Can you share general details?
