How many of you use accident animations at mediation?

Rarely, unless it’s already done for trial. And usually, if I’m this close to trial I don’t mediate. My rationale is that a good case doesn’t need them to settle and a bad case can’t afford them. Having said that, I have substantial verdicts to my name so I don’t need to establish credibility at mediations but I still think it’s a waste of money if your goal is to settle the case.

I realize this is an older post, but I’m just now seeing it. I use animations of client injuries at mediation quite a bit on large cases. For example, for awhile the offers on one of my cases had been around $60K. We eventually went to mediation and presented animations of both the accident and the injuries- we ended up settling for close to $1 million. They are expensive, but if it’s a bigger case that justifies the expense, the animations show the representative from the insurance company you’re willing to spend good money fighting the case and that you believe in the case’s value. I’m a Plaintiff’s lawyer, and sometimes defense attorneys downplay a case to adjusters. I find that animations help solve that problem really quickly. I should note however, be mindful of evidentiary rules. Animations can be wonderful demonstrative aids, but trying to bring them in as evidence is of course problematic.

In an auto accident trial, can you inform the jury in any way that the at-fault driver had insurance? I have a hard time believing a jury would award 7-figure damages if they thought the little old lady defendant had to personally pay. I’m just starting to do PI on the side by myself at my firm, so this is probably a very dumb and obvious question.

I’m an associate attorney at a smallish personal injury firm. Total firm has 12 attorneys, and my office has 2 attorneys, including myself. I’m a first year big law associate in a major market. Leaving for two federal clerkships later this year. Plan was originally to go back to the firm but I honestly hate the work. Should a company go out of business if it hurts consumers? 3M is facing lawsuits for their defective ear plugs, surgical blankets, firefighter foam, PFAs, etc. Someone just got $77.5 million on 1 earplug case and there are about 270,000 military personnel with tinnitus and hearing loss. At least 20,000 people who have had multiple surgeries from their blankets and some who have had limbs amputated, who knows how many have had cancer, etc from chemicals made by 3M. 3M market cap is 87 billion

Need some input. Car accident happened in NY. SC insurance car was rear ended by NY insurance! NY is a no fault state and SC is at fault state, I believe. Now, if the SC driver is in pain and wants to get medical treatment in NY will it be covered by her car insurance ? Or they have to get treatment on a lien. My mom got into accident and I am totally in a different field of law. She is visiting me and will be here for another month and want to at least go for a@check up again. Any help? TIa
