How much harder is it to get hired to in house counsel (preferably IP counsel but I’m open) from patent litigation vs IP transactions?

From personal experience I say a lot harder, transactional experience makes things much easier. I retooled within BigLaw from patent lit to IP transactions for a year before going in house at a small tech startup recently.

I think 5-8 years is generally the golden period to move but making partner then move can open doors to some senior level positions (though there tends to be less of those).

There are significantly fewer IP lit jobs in house than commercial jobs. That said, I’m quite happy as a former IP litigator turned product counsel.

Right, I should have said easier. Definitely sounds like corporate is the way to go for in house prospects though.

I’m considering a move from a large public company to a start up that’s just finishing off its Series B funding round.
