How would this play out during conflict check:

Had a Chase credit card default during law school. Collection agency filed suit in small claims as Chase bank’s assignee. Settled very quickly and voluntarily dismissed by collection agency. Potential firm has presented/is representing Chase in matters.

Is this going to be an issue? Will new firm need a waiver from chase? What are the chances of rescinding offer?

No, OP, your firm is not going to need a conflicts waiver from Chase bank, one of the largest financial institutions in the world, because of your consumer credit card default.

This is not going to be an issue. Suit wasn't even on behalf of chase (assignee isn't representative). Plenty of people have far deeper banking ties with folks theyre contra to in deals than that.

The firm may decide to screen you off from Chase, but it really shouldn't matter. You obligations run to your former clients because you may have learned confidential information about them. Once a matter ends, you don't have obligations to your former adversaries. The same concerns don't exist if you were to represent them in future. Someone please correct me if I'm wrong, but that's what I determined when I looked into the rules. Obviously, firms can choose to be more conservative, but I doubt they'd rescind your offer.

Thanks everybody. Looks like they might look at it under business conflicts—in addition to legal conflicts. Hopefully it’ll all be good.

There’s two kinds of conflicts in law. Ethical (can we) and business or positional conflicts (should we). This isn’t a legal conflict as you wouldn’t have gained any materially relevant information about Chase that could hinder the firm’s representation of them. Chase sold the debt to a collector and you settled with the collector. There shouldn’t even be a business conflict with this. Now, if you never paid the settlement, then perhaps this would be a character issue but that’s up to the firm.

not an issue at all
