OP you seriously think Senate will be generous enough to pass this bill? this is just the beginning before it crumbles out in the Senate floor... Have been in this country for 11 counting years with first H1 back in 2013. Not sure how many years folks have been here but these trends come and go with no outcome at all. When I graduated back in 2011 - there were talks of attaching GC to MS and phd students during graduation and it a big issue looking to progress but nothing materialized. So go figure 🤷🏻‍♀️

They have always favored legal immigrants. The rules just didn’t help people from India. The only legal immigrants complaining are the ones from India

It’s not an stupid argument but you surely are. If cap by nationality needs to be in place it should be at work visa level and not gc. There is no denying that there is demand for h1b by tech companies but the h1b pursuant can’t stay temporary forever if his/her company needs him/her. Once one received the work visa he should be considered fairly for GC irrespective of nationality. How is it fair for illiterate taxi deiver to get gc in an year while ppl with masters and with multiple years experience has to wait for a decade or more to gc just because they are from India

But his question is valid though, I had people with skill set less than me, reporting to me got their gcs for which I had to put in a request for as a manger yet I have been waiting for 8 years. How is that fair...

Even though I am indian, this is a stupid argument. they can go back to their home country. it's not a charity afterall. the problem is India is so underdeveloped and bad that no one wants to go back. it's not anyone's problem but indian citizens'. Nobody gave them a stamp paper promising PR in x amount of time.

Wait a minute, it doesn’t favor Chinese at all. Our average wait time will change from 3 years to 10 years because our backlog is limited compared to the Indian folks. There is a limited set of Chinese who will get the benefit, i.e. those have applied for 485 as late as this year. Everyone else will start facing a longer wait time, mine for example, will likely change to 10 if the bill gets passed🤦🏻‍♀️ definitely not going to support this bill!

If it wasn’t clear, my scenario assumes the backlog has been cleared. So back to the scenario: If there are 10 GCs to hand out on a first come, first serve basis and 100 applicants— 70 Indian nationals, 30 ROW. Which category (i.e Indian national vs. ROW) will likely pick up more GCs? Will it be a guaranteed, fair split of 5 and 5?

^ exactly. Removing the cap would essentially mean any country that can churn out the largest number of applicants (independent of skill) takes all/most GCs.

Great, now half of India will be here. Why do the laws have to be changed because there’s thousands of Indians coming in every day. All this push and mobilizing people to change the laws here, yet no desire to make the any impact back home

As an Indian , I am waiting eagerly for the senate to hold a vote. But being a pragmatist , it seems highly unlikely that anything will come of of this - especially under this administration. Coming from a neutral and a pro- American stand point , I fail to see and demerit in this bill. For ROW, is the entire argument hinging upon the fact that Indians will be the biggest beneficiary or is there anything else here. I have been in this country for 14 years and am still on H1. Do you expect your wait to be more than that ? India produces more engineers than probably all of Europe combined. Hence, there was a need of more Indian folks to support the information technology boom across USA and Europe alike. We just happened to reap the benefit of that at the right time. Just like China was able to become the manufacturing hub at the right time. That does not mean that Indians are smarter than others. On a % of population basis they may not even be on the top of the chain here. Chances are that there are more people from Israel based on a % of population basis. Does that matter to you now ? India is a big country. 1/6 of the world population. So, even based on that the fair share translates to 16%. How’s that for the reverse logic. But all these numbers are pointless. The point is that a skill based visa should be a skill based visa. If you have identified the skill component and put it in the right bucket (based on eb1/2/3) , then the only determining criteria should be the date. I am lucky enough that my kids are born in USA. I dread for people whose kids are turning 18 and going to college and they have to pay out of state tuition as they are not yet permanent residents

It is as true as you want it to be. Those are the requirements and those are the people here on visas. And just FYI , those are the people across nationalities. Apparently labor mill members from different countries are treated differently. And that is ok with you

H1b is employment based and hence gC to these folks are based on merit and employment..Dont look for diversity here ..US already havediverdity lottery and the diversity argument in GC through employment forms only small 10%.

PwC1 - fair enough. Just curious to know how do you plan to get a green card on H1b. I am assuming you are from Indian or Chinese population because it is obvious to not support country cap by being a national from any other country because they don’t have to wait long and this law may make them wait so I totally understand that.

As per my understanding - As per HR1044, When you say that Indians and Chinese will dominate the employment GC pool, you effectively say that other nationalities aren’t as qualified as these two. I personally don’t think that is true. Regardless of how many people of whichever nationality are in the pool, GC will be awarded by skills. If your skill set is lower, you won’t get it, regardless of your nationality. As per current law, nationality determines whether you get GC or not, which is unfair.

Before you guys criticise Indians coming here, there are bigger problems linked to this GC issue. i have colleagues whose daughters/sons are going to turn 18 in a 3-4 years time and they have been living in the country for 10+ years. They will lose their dependent statuses! Where will they go? My colleagues' spouses mostly will not be able to work soon. And there are 100s of 1000s of such ppl. And the numbers are growing. How's it fair to them?

Not sure how it’s relevant but not Indian. These comments are all alarmist. “Where will they go?” And “spouses can’t work anymore” When you make such statements it’s difficult for people to take you seriously. EAD has not been cancelled and tbh if they wanted to get rid of it would have done it by now. So you have EAD and kids can go on F-1 visas Glad to stay on topic if you can prove my previous comment wrong.
