that on H4 the opportunities increase as there’s no sponsorship involved and it’s considered to be a smoother visa.
Me and wife are in exactly same situation. But we decided that she shall keep her H1b and pursue her own i140. It is not worth the risk. If god forbid I lose my job, we both will have to go back.
Your wife can park her h1b while she's on her h4. Check with your lawyers
Yes and no both. I am doing H4 COS to stay out of the renewal for some time. My husband has it approved for 2+ years. If your husband has H1 approved for 2/3 years you can take the plunge - otherwise it’s wise to stay put.
I would stay on the H1
Stay on H1 , if one person gets rejected then, one of you can always switch over to H4
Stay on H1, H4 EAD is going away.
Yup, that’s what I said above, they have been working on it for last few years and nothing happened. God forbid - nothing should happen. Happy working H4s!
You could do it temporarily if circumstances demand. For example, if there’s a startup role that is absolutely your dream role but they don’t sponsor at this time, you can offer to join on H4 with a future opportunity to transfer your H1B and/or potentially your GC application too.
I’m on H4 EAD, but my firm has also sponsored GC so I have an approved I140 and h1b. I won’t change status unless I travel out of country and re-enter or need an extension or H4 EAD is cancelled. I’ll be utilizing this as a backup whenever I decide to recruit.
BCG1: was your GC sponsored after COS from H4 to H1?
