The last question you posed OP is a tragic one and it’s what makes me the most sad about DMA’s current predicament.
#MeToo is a staggeringly important movement and there are many forces waiting to pounce and declare it corrupt or dead. And so far the #MeToo braintrust have been (as far as we know) airtight in their accusations.
Which is why the seemingly haphazard manner DMA conducted their vetting (was there any?) and secured their representation (I thought they had legal advice?) could, if true, be a massive step back.
The inconsistent messaging and the total anonymity made blowback inevitable when million-dollar contracts are involved. Protesting clients and throwing unsubstantiated claims against agency leaders, even if completely true, are extreme measures. One wrong target or false accusation could bring the entire thing down.
This was the advertising industry’s opportunity to ride the wave of the well-funded and well-organized #MeToo movement and I’m concerned DMA may have blown it by being neither.
Hence the 10 million. His logic is future earnings up to retirement.
You pose an interesting question. I think, should he win, he'll be vindicated but not employable in advertising.
Leadership is spineless and the kids these days are too P.C..

Both DMA and his reputation are toast even if he wins his case. Me too will continue and rightfully so but under a more rigid and ethically responsible manner
Public opinion has a fickle memory. History is riddled with examples of men who have been convicted in the court of public opinion only to emerge as “wronged parties” or people who have outgrown the episode in the future. While he will always carry this episode with him, does a successful trial make it more likely that an agency will hire him, or is he PNG for good?
@OP - he HAS been convicted in the court of public opinion. There’s no coming back to being known as your previous self once you’ve been very publicly accused of sexual harassment - or worse. It’s not like being cleared on Judge Judy or something.
These are very serious allegations made regarding what are very serious crimes.
Let’s also consider the following. DMA was conceived as a response not only to sexual harassment in advertising, but to the HR departments that did nothing about it. With that in mind, when I saw these guys being fired, I could only assume that the agency was covering up their own past mistakes for not responding when women came to them. Now that Ralph (and Eric springer) has publicly denied any wrongdoing, and Ralph has actually taken the step of a huge lawsuit, I have to believe that there was nothing on file at the agency against him. At least nothing he was told of.
If that’s true, then I believe he has a good chance of winning. And with that, DMA is done.
But if they have proof that charges were made against him, he somehow knew about them and HR did nothing, not only is he outed as sexual abuser, but also a pretty sad liar. He loses and the need for DMA would be proven. But the whole anonymity thing could be gone forever
