What you've done is unethical. I get that you wanted to play two hands but as soon as you accepted B's offer you should have let C know that. You've made C incur needless costs which now won't be reimbursed. Anyway, do the right thing now and inform C that you've joined someone else.

Well, when the offer letter clearly says at-will employment, you can terminate employment at any time. Hope that helps!! And the same goes with employer. I am sure many ppl have been in situation where they were laid-off without prior notice!

like

Well, I got laid off 2 months back and I had no choice but to initiate transfer at the same time. I was shooting for Employer C who initially said they will file premium eventually delayed the whole process and filed regular as they knew my situation. I am glad that I asked Employer B to start premium transfer which they did else I would have been out of status or had to leave the country. So yeah its not unethical. Desperate times need desperate measures!!

I support you OP. I would have done the same in your situation.

It’s unethical but its smart.. companies play around with job applicants as well.. OP is karma

like

OP- Just inform C that you have accepted the offer as you got H1B-b approved under premium.. my wild guess is if your H1B with C gets approved then you might loose your H1B with current employer based on date of approval... I’m saying this based on experience with one of my friend who was on h4 (no I-140) and had applied for h4 extension and f1 both. His f1 got denied and h4 was approved.. h4 was approved prior to f1 denial... in this case it still worked in his favor as he was still able to stay...he had to appear in front of immigration court to show document why he was overstaying if his f1 was denied

I confirmed that you can hve multiple h1b petitions approved at the same time and can choose which company you want to work with. You can work for only one company. There is also a rule that says you can have multiple jobs on H1B as long as it doesnt overlap. Since I have already started working with Employer B, there will be bridge petition when USCIS sees transfer from prev employer to C as the transfer is with B now. I believe it will get rfe. But its good to let Emp C know that I am starting with employer B on account of approval.

helpful

BTW what role did you get?

My only concern now is what happens to Employer C regular processing since its the transfer from my prev Employer which has already been done to Employer B (approved). I am going to inform Employer C soon as I don’t want to burn bridges.
