I got a call today from the company I was solo in-house for 6+yrs but let me go in February (replaced me) but the replacement did not work out. They want me to return under contract, which I would consider doing but what should be the asking rate? I have learned that benefits are 30% + my old bonus was 20%, so start at 2X?

Get as much as you can and do not expect long term. Remember you have to pay double the taxes as independent contractor. Remember rule of threes, so maybe start with 3x. What if insurance and such? May be a good way to launch a practice! Do not discount due to severance. Just a gig in a gig economy so need to consider the not working time that would be inevitable.

I finally received the offer and it was 1X my prior salary and 60 days (renewable in 30 day increments). It must have been drafted by someone at the company (non- lawyer) because it was filled with typos and inconsistencies in the language. I countered 2X.

For those still following, we settled on 1.5X but included termination for convenience with 10 days notice by either party because I am still interviewing and want to be able to drop them on a dime, if the opportunity presents itself. I expect to hear back from a startup opportunity next week but at least for the next two months, I have a pay increase from my former employer of 150% (severance + contractor pay) so I can’t complain too much. Hopefully the next separation will be on my terms instead of theirs.

For those still following this thread, after one week as a contractor, I received an apology from the CEO for being let go and was offered my old job back, same title/pay. Considering a replacement was brought in, saw me as a threat and let me go (only to get fired shortly thereafter) I feel this is a low ball offer. I think I will remain as a contractor until a better offer comes along unless they want to sweeten the deal. Any thoughts?

I wouldn't take the permanent job. Stay as a contractor and look for something else.

I continuously have a problem with one of our business unit leaders wanting to have a more “direct” relationship with outside counsel on major litigations. This involves scheduling calls to discuss strategy, etc. when I’m not available. Our counsels are sympathetic, but it’s awkward to need to ask them not to take this person’s calls and/or to brief me after the fact. Anyone else dealt with a similar situation? Every single contract the company signs goes through legal review, and we always have revisions (we have specific terms we typically request). The legal issues were previously handled by the CFO with help of outside counsel. 1st year was hard because he was territorial about legal matters, but I reported directly to the board so it wasn't a true issue

2nd year: The CEO retires, and the new one decides to put me under the CFO in the organigram. Now I'm back to square one bc this guy cuts me off any relevant issue!
